Glovers was brought in towards the end of the project by the practice, who were acting as Contract Administrator under the JCT contract, to value the variations and advise on a number of contractual issues which had arisen as the works progressed.
As we became involved our role grew to encompass reviewing the Contractor’s extension of time submission and Final Account. Glovers assisted the practice with monthly valuations, valuation of variations and loss & expense.
The Contractor was dissatisfied with the valuation of its account and so referred the matter to adjudication. Glovers defended the adjudication on behalf of the Employer. The Adjudicator agreed with the vast majority of our valuation of the account and with our assessment of the EOT application. The Adjudicator only awarded a further £3,000 to the Contractor and decided it was responsible for his fees in their entirety.
