Expert Witness (Delay and Quantum) – Community Heating Scheme

Mary Cross was appointed by solicitors on behalf of a Main Contractor in relation to a £5M dispute with their Sub-Contractor whose contract had been determined.

The Contractor was seeking to establish its entitlement to determine the sub-contract and recover the cost of completing the works following the determination. One of the grounds of determination was a failure to proceed regularly and diligently by the Sub-Contractor which required a detailed delay analysis of the whole project.  In addition, Mary had to consider the reasonableness of the time taken by the Contractor in completing the works post-determination.  The delay analysis was carried out in Microsoft Project

David Baldwin was appointed as quantum expert which involved a detailed forensic exercise to ascertain the costs to complete.

Both Mary and David met with the other party’s experts and produced joint statements on matters agreed and not agreed.  The matter proceeded to trial but was settled just prior to Mary being called to give evidence.
